Customer Terms of Use

1. About these terms

Windsor Digital Pty Ltd ("Windsor Digital", "we", "us") operates an online ordering platform that independent hospitality venues ("the venue") use to take orders. These Customer Terms of Use govern your use of the ordering pages and your placement of orders. By selecting "Place order", you ("you", "the customer") agree to these terms and to our Privacy Policy — a notice to this effect is shown at the point of order. If you do not agree, do not place an order. For orders that include alcohol, you are additionally asked to confirm your age and acceptance before ordering (see Section 5).

2. Windsor Digital is a technology platform, not the seller

Windsor Digital provides the ordering technology only. The venue — not Windsor Digital — is the seller and supplier of all food, beverages and goods you order.Your contract for the food is with the venue. Windsor Digital is not a food business and is not a party to the sale between you and the venue. We collect your payment on the venue's behalf as its payment-collection agent.

Any dispute about an order — quality, accuracy, availability, preparation, timing, or fulfilment — is between you and the venue. We can help pass on a message, but we do not prepare food, control the venue, or guarantee any aspect of the venue's goods or service.

3. Placing an order and payment

• Prices, item descriptions, availability, allergen and dietary information are provided by the venue. We do not verify them.
• Orders are processed for payment by Stripe. We do not see or store your full card details.
• Once the venue accepts your order, you authorise the charge to your payment method for the order total (including any modifiers and the venue's service settings).

4. Food safety, allergens and dietary requirements

The venue is solely responsible for food safety, hygiene, allergen information and meeting any dietary requirements you specify. To the maximum extent permitted by law, Windsor Digital is not liable for the quality, safety or non-provision of any food or beverage, any allergic reaction, or any failure by the venue to meet a dietary requirement — even where you provided that requirement through the ordering page. If you have a serious allergy, confirm directly with the venue before consuming.

5. Alcohol (where the venue offers it)

If your order includes alcohol, the venue — not Windsor Digital — is selling and supplying that alcohol under its own liquor licence.

• Before ordering any alcoholic item you must confirm that you are at least 18 years of age and accept these terms (an explicit confirmation step shown only for alcohol orders). You warrant that the confirmation is true.
• We collect your date of birth at checkout as a supporting record only; this does not replace verification. Your date of birth is handled in accordance with our Privacy Policy and de-identified on the same 90-day cycle as your other details.
• Final age verification happens at handover. The venue's staff must sight valid photo ID and may refuse to supply alcohol to any person who is, or appears to be, under 18 or intoxicated, regardless of any order placed.
• You must not order alcohol on behalf of, or for supply to, a person under 18.

6. Acceptable use

You must not, and must not attempt to: (a) introduce any virus, malware or harmful code, or submit harmful input through any field (including your name, order notes or special requests); (b) use any bot, scraper or automated means to access or place orders; (c) circumvent or interfere with any security feature, rate limit or access control; (d) gain or attempt to gain unauthorised access to the platform, other customers' data, or underlying systems; (e) probe, scan or test the platform's vulnerability; or (f) use the platform for any unlawful purpose. We may refuse or cancel orders and block access for any breach.

7. Your indemnity

To the maximum extent permitted by law, you agree to indemnify Windsor Digital from and against any claim, loss, liability or cost arising out of your breach of these terms, your misuse of the platform, or your supply of false information (including a false age warranty).

8. Liability and your Australian Consumer Law rights

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Those consumer guarantees for the food and goods apply to the venue as the supplier.

For the ordering platform that Windsor Digital itself provides: to the maximum extent permitted by law, the platform is provided "as is" and "as available"; we do not warrant it will be uninterrupted, error-free or secure; and our total liability to you for the platform is limited to the amount you paid (if any) for the relevant order. We are not liable for indirect or consequential loss.

9. Privacy

We handle your personal information in accordance with our Privacy Policy, including how we handle order details, optional receipt email, and (for alcohol orders) date of birth.

10. Changes and governing law

We may update these terms from time to time; the version in force is the one shown when you place your order. These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts. This clause does not override any non-excludable ACL right.
